The plot in “Music to Die For” revolved around a Manhattan DJ who was forced to play records cut by singers controlled by a crooked syndicate…Dies - Cecil d. De Mille (77) at his home at 2000 De Mille Drive near Hollywood. He was working on yet another film project called “On My Honor,’ a story of the Boy Scout movement. De Mille died of a heart attack, his third in four years.

 Dies - Carl Switzer (Alfalfa on Our Gang/The Little Rascals) - murdered at age 32 trying to collect a $50 debt. Switzer went to the home of M.S. Stilz in Canoga Park (Los Angeles) with a friend to collect the money. Stilz denied he owed the actor any money. Switzer then hit him over the head with an electric clock dial. Stiltz then got his 38-caliber revolver from the bedroom. Switzer followed him into the bedroom, struggling for the gun. The gun fired harmlessly with Switzer disarming Stilz. Stilz then pushed the actor into a closet and recovered the gun. Switzer left the closet and went back to his friend, saying “he’s trying to kill me’ and pulled out a pocket knife. Stilz appeared in the doorway and fired a shot into Switzer’s stomach. Stilz told police that Switzer borrowed a hunting dog from him, but it got away. Switzer gave the finder $50 and demanded the money from Stilz…

"Stagger Lee" - Lloyd Price

February  - Buddy Holly, J.P. Richardson and Ritchie Valens perish in a plane crash near Clear Lake, Iowa. The four-plane chartered craft carrying the trio and their pilot crashed within minutes after taking off in light snow from the Mason City airport. Holly - 22 was from Lubbock, Tex; Valens (17) of Los Angeles and J.P. Richardson (24) was from Beaumont, Tex. Pilot was Roger Peterson (21) of Clear Lake, Iowa. The troupe had appeared and played before about 1,100 teens and their parents and the surf ballroom in Clear Lake. The Beachcraft Bonanza, chartered from the Dwyer Flying Service, was to have taken the three to Fargo, N.D. Authorities believe bad weather for the crash. Temperature was 18 degrees and a southerly wind was blowing at 35 miles an hour when the plane took off a am. The plane came down about 5 miles northwest of the airport on the Albert Juhi farm. The plane’s left wing first hit the ground and skidded across the snow for 538 feet. The body of Valens was thrown 40-feet. Richardson and Holly were found 20 feet from the wreckage. The body of pilot Roger Peterson was wedged so tightly in the wreckage, it had to be cut loose with torches. All were not discovered until long after dawn.

At first, the performers didn’t have the heart to go through with a scheduled performance at Moorhead, across the state line from Fargo, but changed their minds. Frankie Avalon, and Jimmy Clanton dropped their commitments so they could join the troupe in Sioux City, IA as replacements for the dead stars.

Carroll Anderson, manager of the Surf Ballroom (Holly performing in picture) where they had performed, said the singers were weary of bus travel and “wanted time to get their clothes laundered.” So they chartered a plane for the three-hour flight to Fargo. Richie Valens (Richard Valenzuela) who left high school last year to seek a singing career, recently finished is first motion picture - “Go, Johnny! Go.” His manager, Bob Keene, mourned, “Everybody was saying he was the next Presley.” Mr. Richardson was on leave    from station KTRM in Beaumont, where he was a DJ and program director. Valens is hot on the charts with “Come On, Let’s Go” and “Donna.” Holly, leaves a bride of less than six months – the former Maria Elena Santiago , a former receptionist at the Southern Music Publishing Co. in New York. They were married last August 15. His latest hit is “It Doesn’t Matter anymore”…

In addition, Dick Clark will continue his daily, two-hour ABC-TV show, “American Bandstand,” in the afternoon, and his Saturday night television

May - Jerry Lee Lewis will take another crack at touring in England this September, this time, without his 13 year-old child-wife. In his last attempt, the British called Lewis a “cradle snatcher” and his contract was cancelled… Connie Stevens (20), signs an exclusive seven year singing and acting contract with Warner Brothers. Stevens was the first artist to sign on the new Warner Brothers record label last year. Her contract begins at $300 to $1,200 a week in seven years…

First Grammy Awards - “Nel Blu Dipinto de Blue” by Domenico Modugno gets record of the year/song of the year in the first Grammy awards. June - Hollywood news - George Reeves (45) - TV's "Superman" - commits suicide in his home in the Benedict Canyon area of Los Angeles. According to the Los Angeles Times - Reeves was at home with his fiancé - Lenore Lemmon (35) and New York writer Robert Condon. Reeves and Condon went to their bedrooms with Lemmon still downstairs. Reeves came downstairs irate, saying he was "in no mood" for a party and threatened to throw Bliss out. He apologized and went back upstairs. The hour-long special may include his four sons. He’ll also appear on Frank Sinatra’s first show of the season - same network on October 19. Fooling the public with rigged television shows is a fraudulent and deceptive practice, but not an illegal one, the FCC tells congress. “We can’t determine who has been harmed. The home viewer certainly didn’t pay his way into the show,” said a spokesperson… House investigators are told that Thomas Ervin, producer of the NBC quiz show “Tic Tac Dough” has been fired because he refused to swear to the network that contestants had not been given advance answers…

“Name That Tune” is cancelled by CBS this week. McGeorge de Witt read this statement on the air - “You have all probably seen or heard the new statement of policy of CBS, that it is, among other things, terminating the performance of all shows on which contestants may win large sums of money. “Name That Tune” has been affected by that decision, so that with deep regret, I must tell you that this will be the last “Name That Tune” performance on CBS.”

Unlike CBS, NBC says it will retain its 10 quiz shows. “These program forms virtually parallel the life of broadcasting, radio as well as television. Millions of Americans like and want them.”

At the time, Van Doren was a $4000-a-year university instructor who won $129,000 in prizes on NBC-TV’s “21.”

Radio news – WNEW-TV puts four of its DJ’s on the air and asked them - “Have you ever been approached with a payola offer? All of them agreed that payola does exist and is fairly widespread. DJ’s William B. Williams and Peter Myers said they had been approached. Said Myers: “Well I’ve been approached but I have always turned it down, because, well maybe I am afraid of being caught. Probably that’s it. I guess I am as honey as any jockey” Williams said he was offered a color-TV he “leaned-on” a certain record.

In the letter, he protested charges aired by Congressional investigators that disc jockeys accept millions of dollars each year to build up certain records, especially rock ‘n’ roll. The complaint against disc jockeys was brought on by Burton lane, president of the American guild of Authors and Composers, and read into record by Harris. “For your information, sir” Kaufman’s telegram said, “only 5% of the nation’s disc jockeys program the music for their show.” He said in most cases, the music is chosen by record librarians under the control of radio station programming departments…A congressional committee investigating payola says it is looking into a situation involving TV star Dick Clark , idol of teenagers. ABC which carries Clark’s network shows, issued a statement saying Clark is not guilty of taking payola and said the Clark has agreed to divest himself of his music publishing and record companies in order to avoid a conflict of interest. One of Clark’s properties is Swan Records, whose roster includes Freddie Cannon and Billie & Lillie. Clark hosts “American Bandstand” and “The Dick Clark Show.”

 Disc Jockey Ed McKenzie of WXYZ radio in Detroit quits his $60,000 a year job in part of because of payola. Writing in the current issue of Life magazine, McKenzie says “Because of the charts that are put together by numbers of music trade publishers, that rate the popularity of records, I had to play music on my program that I would never have played otherwise. And the charts are phony because of the most disgusting part of the radio industry - payola. Many disk jockeys are on the weekly payroll of five to 10 records companies which can mean an income of $25 to $50 thousand a year.”

Sydney Nathan , owner of King Records says his firm has paid off disc jockeys all over the country and he has the checks to prove it. “It is a dirty rotten mess and it has been getting worse in the last five years. It is getting so you can’t get your records played unless you pay.” Nathan’s books are being subpoenaed in the New York investigation of disc jockey pay-offs. “We have always paid by checks, not by cash” says Nathan.

Three days later (23), Freed leaves his WNEW-TV teen dance show in a “mutual disengagement” after the station moved to take full control of this show which had been produced by Freed’s own company, Stamford Productions. Freed’s last WNEW-TV show, which was taped in advance, will run until Saturday, November 28. Dick Clark has to sign the same affidavit, as did other ABC radio personalities, which include other WABC radio deejays Martin Block, Fred Robbins, Dick Shepherd and Al Lohman Jr.

At the New York district attorney’s office, Freed refuses to sign a waiver of immunity and face a grand jury investigating payola. Without such a waiver, a witness cannot be prosecuted on the basis of self testimony. “I wouldn’t sign. I refused to sign on advice from my counsel.” Freed claims he has never accepted payola but admitted taking what he called “consultant fees.” Freed’s replacement on WABC radio is Fred Robbins. On his WNEW-TV show it’s singer Richard Hayes, who’s also a deejay on WCBS radio. Hayes is best known for his 1955 hit “Davy Crockett."

More payola - To date, the probes which are spreading to other cities as officials discover the headline values in music personalities, has racked up one confession of giving payola by a record company, King Records. Tom Clark of Detroit said he accepted payola. TV related - NBC announces that Jan Murray, producer and star of the weekday morning quiz show “Treasure Chest,” has asked that his program be terminated…

Clark, who developed substantial interests in record and publishing operations since bowing on “Bandstand” in 1956, was ordered to give up his “outside” music business activities or get off the ABC-TV network. Clark owns a record pressing plant, Swan Records and publishing firm January Music. “American Bandstand”  producer Anthony Mammarella and Clark’s partner in the various enterprises has decided to quit the broadcast business to maintain his ownership in the music companies. Mammerella had been with WFIL-TV for the past eight years and produced the original “Bandstand” with Bob Horn. Mammarella states that his financial status is the best answer to any queries about the legitimacy of his activities and has offered to let any official body examine his books.

 Dick Clark is cleared by the ABC-TV management of any payola activities in a statement which says, “We have examined all evidence available to us concerning these programs and their production organizations and have concluded that Dick Clark has neither solicited nor accepted any personal considerations, money or otherwise, to have any performer appear or to play any recording on any of his programs”…

Joe Niagra , a top Philadelphia deejay at WIBG, resigns his post, but he was going to leave to go to the West coast on December 19. Related possibly - Ed Cohn, head of Lescoe Records, airs charges he hap paid local Philly deejays from 45 to $100 to play the records he was pushing. “This city has the reputation of being the worst place in the country for payola,” said Cohn. The show is hosted by George Christy who’s a free-lance magazine writer who writes Photoplay’s record column. He plays three records - two hits and one potential. Following the holdup, Kaufman was photographed with a woman he described as his wife. Mrs. Kaufman says it was another women and asks the court for $350 a week in temporary alimony, $3,500 counsel fees and custody of their son. She contends her husband was making $1000 weekly including $600 from WINS and income from two publishing companies in which he is a partner….

The Federal Communications Commission demands that the nation’s 5000 plus radio and television stations report under oath, whether their employees have accepted secret payments to plug persons or products. The FCC says the edict is to track down, what they call “sneaky commercials” - plugs that are paid for, without the listener or viewer knowing  it. The order includes 3,525 commercial AM stations, 816 commercial FM stations, 166 educational FM stations, 669 commercial TV stations and 60 educational TV stations.

More December 1959 Payola-Related News - House investigators report they are finding indications of deceptive broadcasting practices in every part of the country and in all levels of the radio-TV industry. The progress report touched on network officials plugging outside interests over their stations, program directors taking kickbacks from performers, record manufacturers rigging “top 40 lists and outright payoffs to DJ’s by record companies. One of the more interesting findings is the ownership of record and music publishing firms by people in radio and television, who then play the music of such companies repeatedly, identifying them as on some “top” list. The information is expected to be the basis of hearings by the House Legislative Oversight Subcommittee early in the next session of Congress.

Prior to giving them checks he said, the money was dispersed to the jocks in cash by field representatives.

More Alan Freed - The New York Post just ran a story revealing details of two mortgages held by Roulette Records from Freed with a face value of $21,000 on which $16,493 is still owing. The Post also said Freed was questioned at the office of Attorney General Leftkowitz “about his relations with Roulette Records, which is headed by night club operator Morris Levy. The New York Post also carried an exclusive interview with a former New York deejay that said he made $41,000 a year from payola inaddition to his regular station salary. The DJ, who now works for a station in another part of the country, said he had to turn part of the payola over to a broker as a commission. The DJ said he and 13 other jocks from local area took part in a meeting of deejays five years ago, at which time they compiled a “blacklist of non-paying record companies and  discussed how to raise the deejays’ under- the-table prices for promoting records.”

DJ Convention - House subcommittee investigators are looking into a Miami Beach disc jockey convention and reports that delegates were lavishly entertained by some record companies. The subcommittee, which exposed rigged television quiz shows, is expected to hold hearings of disc jockey payola next month. It was learned that staff investigators have for some time, been gathering information about the convention and sifting reports that record companies vied with one another in catering to the tastes of 2,500 disc jockeys who gather at the Americana Hotel last May 29-31.

Harold (Hap) Anderson, general manager of WINS radio in New York, in a letter sent to 200 record companies in the country - asked the labels whether they had “ever paid any fees, made any gifts or in any other compensated” any WINS staffers…

CBS says it is banding mentions of products, not directly related to the show’s sponsor - specifically in game shows. “ Art Linkletter’s House Party ” is sure to get hit - it’s one of the shows that identifies its gift donors. Product mentions are a lucrative income for networks.

More payola related - The National Assn. of Broadcasters adopt new provisions in its TV code designed to prevent rigged quiz shows, deceptive advertising and payola practices. The association said any TV station which fails to comply with the TV code loses the right to display the association seal of good practice.

CBS president Louis Cowan quits in an angry protest under rumors of large-scale rigging of quiz shows. Cowan originated the $64,000 question in 1955.

Sensitive - CBS says some of the crowd noises heard in television’s coverage of President Eisenhower’s trip to Europe last August were “dubbed in” by technicians in New York. The network says the “dubbed-in” sound was employed on only a small fraction of their total coverage and had no editorial significance.

NBC now requires all its employees who select music on the 11 owned NBC radio and television stations to make sworn answers to a personal questionnaire. The move is an outgrowth of the congressional payola investigation.

NBC announces the appointment of James Stabile as vice president in charge of standards and practices from the network. He’ll supervise activities begun some time ago to eliminate questionable practices in programming and advertising.

More TV quiz show fallout - CBS is taking any chances and is adding a set of “unusual” announcements to programs beginning this week. You may hear - “audience reaction technically reproduced” or “certain portions of this recorded program were pre-recorded.” The new policy at CBS is that everything appearing must be exactly what it purports to be. For example, there is an announcement covering a situation where an audience watched a show being recorded, but didn’t react the way producers wanted them to react (laugher/applause). In such a case where this was added back in postproduction, CBS would make this announcement - “This program was performed (taped or filmed) before a live audience with audience reaction technically augmented.” In another example - “Portions of this program are fiction” will be used in a situation that purports to be real but is actually fictionalized such as a courtroom scene…
